Mediation agency, which entered our law in 2012 as an alternative solution, is an out-of-court solution.

Mediation in dispute resolution, is a fast, effective and economical solution.

Our office provides solutions to disputes, which is a fast and effective legal solution, especially by directing its clients effectively.

The legislator has established mediation as a system that brings together the parties to meet and negotiate, by applying systematic techniques. In this system, it is aimed to establish a communication process between the parties in order to understand each other and thereby produce their own solutions. In case it turns out that the parties cannot produce solutions, they can also offer a solution proposal; It is a dispute resolution method carried out voluntarily and with the participation of a neutral and independent third person who has received specialization training.

The main thing is to execute Mediation activity voluntarily. However, as of 01.01.2018, application for mediation in labor disputes and commercial disputes from 01.01.2019 have been made compulsory. Apart from that, the system is applied in all areas of law except Public Law.

It is also widely applied in areas such as Rental Law, Family Law, and Consumer Law.

 

Basic Principles in Mediation:

– Voluntary and equality principle: The parties are free to apply to the mediator, to continue the process, to conclude or to give up this process. The parties have equal rights both when applying to the mediator and throughout the process.

– Confidentiality: Unless otherwise agreed by the parties, the mediator is obliged to keep the information and documents presented to him in the framework of the activity or otherwise obtained and other records confidential. Unless otherwise agreed, the parties and other persons participating in the negotiations must also comply with this confidentiality.

– The statements or documents are not available: The parties, the third party, including the mediator or those who participate in the mediation, cannot submit and testify the statements or documents included in the mediation process as evidence when the lawsuit is filed or applied to the arbitration.
